Dallas County, 14th District Court Minutes, 1846 – 1855

(p. 279) Monday, May 10th, 1852
Present are Bennett H. Martin, Judge; Nat M. Burford, District Attorney; Edward C. Browder, Clerk; T. C. Hawpe, Sheriff.
Sheriff returns the jury list with the exception of William James Snow and James Murray. The following 15 men drawn for the Grand Jury: William Jenkins, William B. Elam, Solomon Derrett, Daniel Helvy, D. R. S. C. Galloway, C. Renfro, William Myers, Peter Norboe, Enoch Horton, W. F. Ming, W. F. Newton, Benjamin Guile, Enoch Dye, James E. Jackson, William Shannon. William Jenkins, Foreman; Wesley Chenault, Constable, as special Bailiff.
Court ordered that a special venire be issued for 17 men to serve as jurors. Ordered that the criminal docket be taken up on Wednesday.
Ordered that C. C. Overton and Richard Alston be excused from the jury. Ordered that M. K. Selvidge be fined the sum of $5. for contempt of court and that he be in the custody of the sheriff until the fine and cost are paid.

William E. Russell, Esquire appeared in open court and requested a license to practice law in the district and county courts in the state of Texas. The license was issued and oath taken by said William E. Russell.

Parties came by their attorneys, the case is dismissed as to Huitt and then submitted to a jury. Jury: William M. Cochran, Foreman and eleven others. Verdict: In favor of the plaintiff for $211.75, plus cost.

Parties appeared by their attorneys and the case dismissed for want of surety. Therefore ordered that the defendant recover from Mercer Fain the full amount of his costs together with the sum 15 cents for each 100 words of the final record of this case and that execution issued for the sum.

The parties in person and by their attorneys’, the case continued on the affidavit of A. G. Walker.
Ira Ellis vs John Davis. Trespass to Try Title.
Defendant appears, the plaintiff does not appear in person nor by attorney although called three times; ordered by court that case be dismissed for want of prosecution. Defendant to recover his cost together with 15 cents for each 100 words of the final record.
Isaac Anderson vs C. G. Cole. Trespass.
Parties appear in person and by their attorneys and case was submitted to a jury consisting of William B. Miller, foreman and 11 others. Jury finds for the plaintiff and assesses the damage at $8.00. Plaintiff to recover from C. G. Cole the sum of $8.00 and all costs together with 15 cents for each 100 words of the final record.

Jury: William Miller and eleven others. Verdict: Find for the plaintiff and it is ordered that the plaintiff recover the following described tract of land for 480 acres granted to Crawford Grigsby and conveyed to Samuel G. Newton (land description given includes the following names: Jefferson Tilly, Samuel G. Newton, John Henry, and Edward Cunningham). Plaintiff to recover all cost. Sheriff to put plaintiff in custody of said property.

Plaintiff is to recover of the defendant $268.65, and all cost together with 15 cents for each hundred words of the final record. Defendant moves for a mistrial which was overruled by the court. Then defendant gave notice that he would appeal to the Supreme Court.

Hibbert & Crockett, Admrs., of Hewett vs A. J. Hewitt. [blank]
Parties waived a jury and the case submitted to the court. Ordered that the said A. J. Hewett recover of the defendant Hibbert & Crockett, administrators of John Hewett the sum of $7.21 plus 15 cents for each 100 words of the final record and this judgement be certified to the probate court whereupon the plaintiff moved for a new trial which was overruled. They gave notice that they would appeal to the Supreme Court.
C. G. Cole vs J. W. Elliott. Petition in Debt.
Jury: William M. Cochran and 11 others. Verdict: find the balance due the plaintiff of $557.80. Plaintiff to recover this sum from the defendant plus the cost of his suit.

Defendant called but did not appear; therefore, the State of Texas is to recover from the defendant and Samuel Ramsey, Jonas Buskirk, his securities, the sum of $300 being the amount of the bond. A scire facias issued herein returnable to the next term of court.

Ordered that the Clerk of the District Court be allowed $25.00 for extra services.
Ordered that the Sheriff of Dallas County be allowed the sum of $25.00 for extra services.
